第1条（本契約の目的）

本使用許諾契約書（以下「本契約」）は、MarkDownDominance（以下「本ソフトウェア」または「MDD」）の使用に関する条件を定めるものです。お客様が本ソフトウェアを購入、ダウンロード、インストール、または使用した時点で、お客様は本契約の内容に同意したものとみなされます。本契約に同意いただけない場合は、本ソフトウェアのインストールおよび使用を行わないでください。

第2条（使用許諾の付与）

本ソフトウェアの著作権者（以下「当社」）は、お客様に対し、本契約の条件に従うことを条件として、本ソフトウェアを個人的用途または社内業務の用途で使用するための、非独占的かつ譲渡不可能な使用権を許諾します。本契約は本ソフトウェアの所有権を移転するものではなく、本ソフトウェアはあくまで「使用許諾」されるものであり、「販売」されるものではありません。

第3条（禁止事項）

お客様は、法令により明示的に許容される場合を除き、以下の行為を行うことはできません。

• 本ソフトウェアの複製、再配布、転売、貸与、またはサブライセンスを行うこと
• 本ソフトウェアをリバースエンジニアリング、逆コンパイル、または逆アセンブルすること
• 本ソフトウェアに付されている著作権表示、商標、その他の権利表示を削除または変更すること
• 本ソフトウェアを利用して競合製品を開発すること

第4条（データの取り扱い）

本ソフトウェアは、入力されたファイルの変換処理をすべてお客様のコンピューター上でローカルに実行します。当社の調査（ソースコードの精査）の結果、MDD自体のコードには外部サーバーへの通信、テレメトリ送信、利用状況の収集などを行う機能は含まれていません。インターネット接続なしで動作します。

なお、本ソフトウェアは複数のオープンソースコンポーネントを内部で利用しています。これらの構成や条件については、同梱の THIRD-PARTY-NOTICES.md をご参照ください。

第5条（無保証）

本ソフトウェアは「現状有姿（AS IS）」で提供されます。当社は、本ソフトウェアが特定の目的に適合すること、エラーなく動作すること、または中断なく利用できることについて、明示または黙示を問わず、いかなる保証も行いません。

第6条（責任の制限）

法令で認められる最大限の範囲において、当社は、本ソフトウェアの使用または使用不能から生じるいかなる損害（データの損失、業務の中断、逸失利益を含みますがこれらに限りません）についても、一切の責任を負いません。当社の責任範囲は、いかなる場合であってもお客様が実際に支払った購入代金の額を上限とします。

English Version

1. Purpose

This End User License Agreement (the "Agreement") governs your use of MarkDownDominance ("MDD" or the "Software"). By purchasing, downloading, installing, or using the Software, you agree to be bound by this Agreement. If you do not agree, do not install or use the Software.

2. License Grant

Subject to the terms of this Agreement, the copyright holder ("we" or "us") grants you a limited, non-exclusive, non-transferable license to use the Software for your own personal or internal business purposes. This Agreement does not transfer ownership of the Software to you; the Software is licensed, not sold.

3. Restrictions

Except as expressly permitted by law, you may not:

• copy, redistribute, resell, rent, lease, or sublicense the Software;
• reverse engineer, decompile, or disassemble the Software;
• remove or alter any copyright, trademark, or other proprietary notices; or
• use the Software to develop a competing product.

4. Data Handling

The Software performs all document-conversion processing locally on your own computer. Based on our review of MDD's own source code, MDD contains no functionality that sends data to a remote server, collects telemetry, or tracks usage. No internet connection is required to use the Software.

The Software does bundle a number of open-source components. See the accompanying THIRD-PARTY-NOTICES.md for details on those components and their licenses.

5. No Warranty

THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

To the maximum extent permitted by law, in no event shall we be liable for any damages arising from the use or inability to use the Software, including but not limited to loss of data, business interruption, or lost profits. Our total liability under this Agreement shall not exceed the amount you actually paid for the Software.
